Provider and acceptance
TriHerm is the commercial name used for the products and services presented on this website. The contracting provider is the person or entity identified in the applicable checkout, order confirmation, invoice, proposal or service agreement. Questions about an order or these terms may be sent to mail@triherm.com.
You accept these terms when you place an order, complete a checkout that includes an acceptance control, accept a proposal or service agreement, or access a paid digital product. If you act for a company or other organization, you confirm that you have authority to bind it. Mandatory rights that cannot legally be waived remain unaffected.
Contract documents and priority
A purchase may also be governed by an offer page, confirmed scope, proposal, statement of work, service terms, subscription terms and refund policy. A signed agreement or confirmed proposal controls first, followed by the specific offer or order terms, then the applicable service or subscription policy, and finally these general terms. A more specific document controls only for the subject it addresses.
Marketing examples, estimates, demonstrations and preliminary discussions are informational unless they are expressly included in the confirmed scope.
Eligibility and lawful use
You must be legally able to enter into the transaction and provide accurate contact, billing and project information. Minors may not purchase without authorization from a parent or legal guardian.
Products and services may not be used to violate law, infringe third-party rights, distribute malicious code, obtain unauthorized access, process data without lawful authority, mislead users or create systems intended for fraud, harassment or abuse. TriHerm may reject, pause or terminate work that presents a legal, security or ethical risk.
Orders, scope and prerequisites
Payment records a commercial transaction but does not by itself mean that intake is complete, scope has been accepted or delivery has started. The published or confirmed deliverables, exclusions, assumptions, revision limits and prerequisites define the purchase.
Delivery targets begin only after required information, content, approvals, credentials and lawful access have been provided and the scope review is complete. Missing information, delayed decisions, access restrictions or customer-requested pauses suspend the delivery target for the corresponding period.
A request outside the purchased scope may be declined, clarified, moved to a separate quote or upgrade, or treated under the refund policy when the purchased offer cannot reasonably be delivered.
Prices, taxes and payment
Unless an offer states otherwise, displayed prices are in United States dollars (USD). The checkout or proposal identifies the amount due, payment timing and any recurring charge. Applicable taxes, currency-conversion charges and third-party provider fees may be added or charged separately when disclosed or legally required.
Payments are processed by the provider shown at checkout, including Stripe for applicable offers. Payment processors handle payment credentials under their own terms and privacy notices. You authorize only the one-time or recurring charges clearly disclosed and expressly accepted during the transaction.
An order may be paused, withheld or cancelled when payment is declined, reversed, disputed, suspected to be fraudulent or materially inconsistent with the confirmed order. You remain responsible for valid undisputed amounts and for keeping billing information current.
Digital products
Digital products are delivered through the access method stated on the offer or confirmation page. Unless a different license is expressly stated, purchase grants the customer a non-exclusive, non-transferable license to use the product for the customer's own internal or business operations.
You may adapt purchased templates and documents for your own organization, but you may not resell, sublicense, publish, share publicly or redistribute the original product or a substantially equivalent copy. Access credentials may not be shared outside the purchasing organization.
Report missing access, corrupted files or a materially defective delivery promptly to mail@triherm.com so TriHerm can restore access, replace the file or apply the refund policy as appropriate.
Professional and implementation services
Reviews, reports, blueprints, implementation work, websites and custom systems are professional services. The applicable offer or proposal defines the deliverables, delivery target, revision allowance, acceptance criteria and excluded work.
TriHerm may rely on information and approvals supplied by the customer. The customer is responsible for reviewing business, legal, tax, regulatory, security and operational decisions before using a deliverable in production. TriHerm does not provide legal, accounting, tax or regulated professional advice unless a signed agreement expressly says otherwise.
Subscriptions and recurring services
A recurring service is activated only under the conditions disclosed in the applicable checkout or subscription terms. Before consent, the checkout must identify that billing is recurring, the amount, frequency, activation point and expected charge date. Recurring charges require express informed consent.
Where automatic renewal applies, TriHerm will provide the advance renewal notice required by applicable law and a mechanism to request cancellation without penalty. A cancellation request is recorded when submitted; unless the offer or mandatory law requires an earlier end, service continues through the paid billing period and no automatic prorated refund is issued.
Care Basic has additional product-specific rules, service boundaries, transition periods and billing-management procedures in the Subscription terms. Those specific rules control Care Basic.
Customer responsibilities
You are responsible for the accuracy, legality and completeness of customer-provided content, data, instructions and approvals; for obtaining rights and consents needed to use them; for maintaining independent copies of important data; and for protecting credentials and access links.
You must identify security, compliance, accessibility, retention, localization or industry-specific requirements before scope confirmation. Requirements disclosed after work begins may require a scope change, revised delivery target or separate fee.
Third-party services
A solution may depend on third-party hosting, domains, email, analytics, artificial-intelligence models, payment systems, scheduling tools, APIs or other software. Unless explicitly included, their fees, accounts, terms, availability and compliance obligations are separate from TriHerm's charges.
TriHerm does not control third-party outages, policy changes, pricing, account restrictions or discontinued features. Reasonable assistance with a third-party issue may be included only when it falls within the confirmed scope; replacement or migration work may require a separate scope.
Intellectual property
The customer retains ownership of customer-provided content, trademarks and data. TriHerm retains ownership of its pre-existing materials, reusable methods, know-how, libraries, templates, internal tools and generalized components, including improvements that do not disclose the customer's confidential information.
Ownership or licensing of custom deliverables is determined by the confirmed offer, proposal or service agreement. Unless that document states otherwise, after full payment TriHerm grants the customer a perpetual, non-exclusive license to use the final paid deliverables for the customer's own operations. Third-party and open-source components remain governed by their original licenses.
TriHerm may identify the customer and display non-confidential public work in a portfolio only when permitted by the applicable proposal, written approval or the public nature of the completed work. A written confidentiality or no-publicity commitment controls when present.
Confidentiality, data and security
Each party must use reasonable care to protect non-public information received for the transaction and use it only to perform or receive the services, except when disclosure is authorized, required by law or necessary for approved providers supporting delivery.
Personal data is handled under the Privacy Policy and any applicable written data-processing terms. No internet, cloud or software system can be guaranteed completely secure. You must notify TriHerm promptly of suspected unauthorized access involving credentials or systems provided for the work.
Results, warranties and service availability
TriHerm will perform professional services with reasonable care and will address verified defects attributable to the delivered work within any support or correction period stated in the offer. This commitment does not cover customer changes, unsupported third-party changes, misuse, missing maintenance or circumstances outside the confirmed scope.
Business, revenue, conversion, search-ranking, regulatory, artificial-intelligence output and automation results depend on factors outside TriHerm's control and are not guaranteed. Except for express written commitments and warranties that cannot legally be excluded, products and services are provided without implied guarantees of uninterrupted operation, fitness for every purpose or a particular commercial result.
Limitation of liability
To the maximum extent permitted by applicable law, neither party is liable to the other for indirect, incidental, special, punitive or consequential losses, or for lost profits, revenue, goodwill or data, arising from the transaction when those losses were not the direct and reasonably foreseeable result of a breach.
To the maximum extent permitted by applicable law, TriHerm's aggregate liability arising from a specific order is limited to the amount paid to TriHerm for that order during the twelve months before the event giving rise to the claim. This limit does not apply to fraud, intentional misconduct, liability that cannot legally be limited, or the customer's obligation to pay valid charges.
Business-customer indemnity
When the customer purchases for business use, the customer will defend and indemnify TriHerm against third-party claims caused by customer-provided content, unlawful instructions, lack of required rights or consents, misuse of a deliverable, or violation of these terms. This obligation does not apply to the extent a claim was caused by TriHerm's own breach, infringement or misconduct.
Cancellation, refunds, suspension and termination
Cancellation and refund eligibility depend on the type of purchase, work already performed, access already delivered, non-recoverable third-party costs and mandatory law. The Refund Policy and any specific offer terms apply. Nothing in these terms removes a statutory withdrawal, cancellation, repair, replacement, refund or compensation right.
TriHerm may suspend access or work after material non-payment, unlawful use, security risk, abusive conduct, repeated failure to provide required inputs or a material breach that is not corrected after reasonable notice when notice is appropriate. Termination does not erase accrued payment obligations, confidentiality duties, licenses already granted after full payment or provisions intended to survive.
Changes and electronic notices
TriHerm may update these terms for future transactions by publishing a new version and effective date. A material change affecting an existing recurring service will be communicated through the available contact method before it takes effect when required by law. The version accepted for a completed one-time order remains part of that order unless both parties agree otherwise.
Operational notices, invoices, delivery messages, renewal notices and billing-management links may be sent electronically to the email or account supplied by the customer. You are responsible for maintaining a working contact address and reviewing messages related to the transaction.
Disputes and contact
Before starting formal proceedings, the parties should attempt in good faith to resolve an order-specific dispute by writing to mail@triherm.com with the order reference and a clear description of the requested resolution. TriHerm will review the transaction record and respond through the available contact information.
The transaction is governed by the law that applies to the contracting provider, customer and place of supply, including any mandatory consumer rules. Consumers may use the competent consumer-protection authority or other forum available under applicable law. These terms do not require a consumer to waive a non-waivable forum or remedy.
